GENERAL TERMS AND CONDITIONS

All Vex Clothing items are handcrafted in our California studio by our small, talented team of designers. We’re working around the clock to ensure your order is up to our quality standards and are experiencing delays due to COVID-19, so please allow 4–6 weeks for production and shipping. Please note that the entire e-commerce industry has been experiencing many shipping related issues due to heavy volumes. Vex Clothing unfortunately can't control and is not responsible for delays or lost packages. We will do our best to assist our customers by filing insurance claims when applicable.

Expedited service may be available upon request and will depend on the availability of materials. Rush fees may apply. Ready to Ship items will dispatch within 48 hours of your purchase Monday–Thursday. If you purchase both Made To Order and Ready to Ship items, they will all ship at the same time.

All orders shipped within the state of California will be charged 7.75% sales tax. International orders are subject to customs and duties fees. Vex Clothing is not responsible for any additional charges or delays caused by customs’ clearance process. 

CANCELATIONS:

We will allow cancelations within 48 hours of the order being placed. After that no cancelations will be accepted because each item is hand made to order - materials, supplies and production have begun. Please reach out to us at sales@vexclothing.com or 773-282-0723. 

RETURNS:
Since each item is made to order, our items are not returnable with the exception of items marked READY TO SHIP. Ready To Ship items are pre-made and can be returned for store credit. We can also do alterations on items for an additional charge.
READY TO SHIP items are returnable only for store credit within 15 days. We do not issue refunds. Shipping fees, insurance, rush fees, taxes or duties will not be refunded. Undergarments are final sale due to sanitary reasons. Please contact us for a return authorization form before shipping the product back to us.

CUSTOM ORDER DESIGN TERMS AND CONDITIONS

Any style ordered, not offered in the Vex Clothing, Inc. catalog or website is considered a custom item. Custom items are subject to custom order terms and conditions. Processing time for custom orders and collection customization are based on availability of materials needed for completion. Vex Clothing, Inc. will provide an estimated time of production for each custom item, usually 5 to 6 weeks. The estimated time of production does not include the design process or custom fittings. Expedited service may be available upon request. If expedited service is needed a rush fee and express delivery charges may apply.

All custom orders and Made to Measure order must have the following forms submitted with the order:

  

PAYMENTS: 
Vex Clothing accepts the following forms of payment:
  • All Major Credit Cards: Visa, MasterCard, American Express, Discover
  • Money Orders
  • U.S Fund checks made out to Vex Clothing, Inc.(*All checks must clear before the order can be processed)
  • PayPal payments made payable to sales@vexclothing.com.

Include customer name, mailing address, and email address on all methods of payment, in order for Vex Clothing to properly and accurately credit the account.

 SHIPPING: 

Shipping in the U.S. and Canada is FedEx Ground with insurance. All other locations will be shipped express through USPS.com in order to verify a tracking number.

 SALES TAX & CUSTOMS

All orders shipped within the state of Illinois will be charge 10.25% sales tax. All orders shipped outside the state of Illinois will not be charged sales tax. International orders are subject to customs fees. Vex Clothing, Inc. is not responsible for any additional charges.

 

  CUSTOMER ACKNOWLEDGEMENT:

The CUSTOMER acknowledges the garment purchased from Vex Clothing, Inc. is custom made for the CUSTOMER. As such, the CUSTOMER cannot return the item once the order is purchased. All sales of custom apparel are final sale. In that regard, Vex Clothing, Inc. relies on the virtual fitting session with the CUSTOMER to produce the garment. However, the CUSTOMER may forward the CUSTOMER’s own measurements to Vex Clothing, Inc. and Vex Clothing, Inc. will produce the garment in accordance with the measurements the CUSTOMER has provided. Vex Clothing, Inc. declares to make reasonable attempts to alter and fit the garment as part of the custom in-house creation process. Vex Clothing, Inc. cannot be responsible for any faulty measurement made by the CUSTOMER or any subsequent failure of the garment to fit properly. According to Vex Clothing, Inc. all customer requested alterations on self-measured apparel or the change in size and/or shape of the customer shall be subject to standard alteration fees. Some individuals are sensitive and/or allergic to latex and/or rubber intended for extended skin contact. Such sensitivity and/or allergic reaction can be severe. The CUSTOMER affirms the recommendation of Vex Clothing, Inc. to test a small patch of skin against the latex or rubber material before the purchase of the garment. The CUSTOMER agrees that Vex Clothing, Inc. shall not be responsible for any such sensitivity and/or allergic reaction the CUSTOMER may experience as a result of wearing the Vex Clothing, Inc. apparel. Furthermore, the CUSTOMER agrees to indemnify and hold harmless Vex Clothing, Inc., its officers, employees, agents, successors and assigns from any and all such claims whether based on contract, tort, or any other legal theory. Vex Clothing, Inc. warrants the CUSTOMER the apparel to be created and delivered will be free from defects in material and workmanship. The warranty provided by Vex Clothing, Inc. is for a period of thirty (30) days from the date of shipment or pick-up by Vex Clothing, Inc. to the CUSTOMER. If the apparel sold to the CUSTOMER fails, excepting wear and tear and/or abuse of the apparel during the warranty period Vex Clothing, Inc. shall correct any defect in the materials upon an examination of the apparel for wear and tear and/or abuse. The compliance of Vex Clothing, Inc. shall only ensue upon the prompt notification from the CUSTOMER to Vex Clothing, Inc. within the allotted warranty period. The CUSTOMER shall be responsible for all shipping costs of the apparel to and from Vex Clothing, Inc. Under this warranty, the liability of Vex Clothing, Inc., whether the claim is based on contract, negligence or any other legal theory, shall not in any case exceed the cost of correcting defects in the apparel. Upon the expiration of the warranty period all such liability of Vex Clothing, Inc. shall terminate. The preceding details shall constitute the exclusive remedy of the CUSTOMER and the exclusive liability of Vex Clothing, Inc. Under no circumstances shall Vex Clothing, Inc. be responsible for changing the size of the apparel due to a change in the physical size and/or shape of the CUSTOMER. The foregoing warranty is exclusive and in lieu of all other warranties, whether written, oral, implied, or statutory. No warranty of merchantability or fitness for a particular purpose shall apply. In no event, whether as a result of breach of contract, warranty, alleged negligence, or any other legal theory, shall Vex Clothing, Inc. be liable for special or consequential damages. Vex Clothing, Inc. shall not be liable for special or consequential damages including, but not limited to, loss of profits or revenue, loss of use of the apparel, cost of the apparel, cost of substitute apparel, facilities or services, downtime or event cancellation costs, or claims of the CUSTOMER for such damages.
